You agree to notify us immediately at hello@firerusharcade.com of any unauthorized use of your account or any other security breach. Fire Rush Arcade will not be liable for any loss or damage arising from your failure to protect your account credentials. We reserve the right to suspend, disable, or delete your account at our sole discretion if we believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if your account has been inactive for an extended period.

4. Acceptable Use

You agree to use Fire Rush Arcade only for lawful purposes and in accordance with these Terms. You shall not:

• Use the platform in any way that violates any applicable federal, provincial, or local law or regulation in Canada.
• Attempt to gain unauthorized access to our systems, servers, networks, or any other user's account.
• Use automated scripts, bots, crawlers, or any other automated means to access or interact with our platform without our prior written consent.
• Interfere with or disrupt the operation of our platform, servers, or networks connected to our services.
• Transmit any viruses, malware, worms, or other malicious code through our platform.
• Harass, threaten, intimidate, or impersonate any other user or person.
• Upload, post, or transmit any content that is defamatory, obscene, offensive, or infringes on the intellectual property rights of others.
• Exploit any feature of the platform, including Wizard's Gem Vault and other arcade experiences, through cheating, manipulation, or other unfair practices.
• Attempt to reverse-engineer, decompile, or disassemble any part of our platform's software or technology.

5. Intellectual Property

All content, features, and functionality on Fire Rush Arcade, including but not limited to text, graphics, logos, icons, images, audio clips, video content, animations, game mechanics, interactive modules, software, and the overall design and arrangement thereof, are the exclusive property of Fire Rush Arcade or its licensors and are protected by Canadian and international copyright, trademark, patent, and other intellectual property laws. The Fire Rush Arcade name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Fire Rush Arcade. You may not use these marks without our prior written permission. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use our platform for personal, non-commercial entertainment purposes only, subject to these Terms.

6. User Content

Fire Rush Arcade may allow you to submit, post, or share content such as comments, feedback, suggestions, community forum posts, and other materials ("User Content"). By submitting User Content, you grant Fire Rush Arcade a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and improving our platform. You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not violate the rights of any third party. We reserve the right to remove or modify any User Content at our sole discretion, without notice, for any reason, including content that we determine violates these Terms or our Community Guidelines.

7. Disclaimers

FIRE RUSH ARCADE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that our platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Fire Rush Arcade is a free social entertainment platform designed for interactive enjoyment. No purchase is necessary, and no real-world monetary value is attached to any in-game items, progress, scores, or virtual elements. Any resemblance to real-world financial transactions is purely aesthetic and part of the entertainment experience.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, IN NO EVENT SHALL FIRE RUSH ARCADE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE OUR PLATFORM. Our total aggregate liability to you for all claims arising from or related to your use of Fire Rush Arcade shall not exceed one hundred Canadian dollars (CAD $100). This limitation applies regardless of the legal theory upon which your claim is based, including contract, tort, negligence, strict liability, or any other basis.

9. Indemnification

You agree to indemnify, defend, and hold harmless Fire Rush Arcade, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms, your use of our platform, any User Content you submit, or your violation of any law or the rights of a third party. This indemnification obligation shall survive the termination of these Terms and your use of Fire Rush Arcade.

10. Governing Law

These Terms of Service and any disputes arising from or related to your use of Fire Rush Arcade shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the courts located in the Province of Ontario, Canada, and you consent to the personal jurisdiction of such courts. Notwithstanding the foregoing, Fire Rush Arcade reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights or other proprietary rights.

11. Changes to Terms

Fire Rush Arcade reserves the right to modify, amend, or replace these Terms of Service at any time at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of this page and may provide additional notice through our platform, such as a prominent banner or notification. It is your responsibility to review these Terms periodically. Your continued use of Fire Rush Arcade after any modifications to these Terms constitutes your binding acceptance of the revised Terms.
